Across Osceola County, e-bikes and electric scooters are becoming increasingly common. From neighborhood streets to sidewalks near schools and parks, these devices offer convenience and mobility—but they also introduce new safety risks and legal questions many residents may not fully understand.

Unlike traditional bicycles, e-bikes can travel at much higher speeds and often share spaces with pedestrians and vehicles. When accidents occur, determining who is responsible can quickly become complicated.

Here are several important things riders and drivers should keep in mind.

Understand Where E-Bikes Are Allowed

Florida law allows many e-bikes to be treated similarly to traditional bicycles, but local rules, road types, and riding behavior can affect where they are legally permitted.

Riders should be aware of speed limits, sidewalks, and designated bike lanes to avoid potential legal issues.

Know What Happens When an Accident Occurs

E-bike accidents can involve multiple scenarios. A rider could collide with a pedestrian, be struck by a vehicle, or lose control due to road hazards.

Determining liability often depends on traffic laws, rider behavior, and roadway conditions.

Drivers Must Stay Alert

Motorists should be especially cautious when sharing the road with e-bike riders. Their speed and smaller profile can make them difficult to spot, particularly at intersections.

Staying aware of bike lanes and reducing distractions can help prevent serious accidents.

Safety Equipment Matters

Helmets, lights, and reflective gear can significantly reduce the risk of injury and improve visibility for riders.

While some safety equipment may not be legally required for all riders, using it is strongly recommended.

Why Uninsured Motorist Coverage Matters

If an e-bike rider is struck by a driver who has little or no insurance coverage, medical expenses and other damages can quickly add up.

Uninsured/Underinsured Motorist (UM) coverage helps protect you and your family in situations where the at-fault driver cannot fully cover the costs of an accident.

Whether you are thinking about leaving your marriage or have just been served with divorce papers, when you have the wrong information about what to expect, this already tense situation becomes more difficult. However, by knowing some of the common myths about Florida divorce, you can avoid unnecessary stress and confusion.

Committing Adultery Means Losing Everything
Florida is a “no-fault” divorce state which means that neither party’s role in causing the marriage to end will be a basis for filing for divorce. This does not mean, however, that adultery is irrelevant during a Florida divorce. If the unfaithful party has used marital resources in connection with their affair, the court can consider this fact when deciding how to divide the couple’s property and debts. Additionally, the court can look at the financial harm which the unfaithful spouse caused the other when determining whether or not to award alimony. Lastly, under certain circumstances, an extramarital relationship may also impact the adulterous parent’s custody and visitation rights.

I Will Lose my House
When a couple divorces, Florida law requires that their marital property be divided according to the principle of “equitable distribution.” This process involves looking at different variables and apportioning the couple’s assets fairly. When the divorcing parties own a home together, they usually will have two choices: (1) Someone gets the house, assumes the mortgage, and pays the other for some of the equity in the property; or (2) The couple sells the house and splits any proceeds or expenses. How the assets are divided will come down to what is reasonable in the context of other factors in the case.

The Mother will Always get Primary Custody of the Children
While a mother’s relationship with the children will be important to a court when deciding parental responsibility and time-sharing, the father’s connection will be as well. Florida law presumes that shared parental responsibility and equal time-sharing are in the best interest of a child absent any evidence to the contrary. The law also provides numerous “best interest” factors for the court to examine while reaching its decisions. When it is shown that a father has a positive and healthy relationship with his child, it is probable that he will allowed to spend equal time with them and have an active role in making important decisions regarding their care and education.

Divorce has to End in Trial
Despite how legal cases are depicted on television and in film dramatic courtroom battles are not common. This is especially true in divorce cases. Parties tend to prefer settling their issues rather than leaving choices about their personal lives up to a court. There are different ways to settle and you do have the option of going to trial. However, regardless of how you choose to proceed, you will need the advice of an experienced family law attorney to protect your interest.

Few things are better in the Sunshine State than taking your bicycle out for a spin. Unfortunately, Florida leads the nation for bicycle fatalities. Here are some tips for bicyclists and drivers to keep the roads safe.

How bicyclists can stay safe on the roads

Bikers should make sure their vehicles meet Florida safety guidelines. Specifically, bicyclists should use a headlight while the sun is set, which lets other vehicles see them at night. Additionally, all bikes should have reflective lights and working breaks.

Although Florida doesn’t require cyclists over 16 years old to wear helmets, wearing one can minimize injury and can even save your life if you’re hit by a car.

When on the road, bicyclists should obey all traffic signs and signals, including stop signs and traffic lights. Bikers can use hand signals to let other vehicles around them know their intention to turn or go straight at an intersection. Be aware that cars may not signal at intersections, so be prepared to stop or swerve if a car starts to turn in front of you.

Bikers should ride single file, as close to the right-hand side of the lane as possible if there isn’t a bike lane. If there is a bike lane, look ahead to make sure there aren’t vehicles blocking the lane.

Bicyclists should take particular care when cars are parked along the street to the right. People getting in and out of cars may open their doors suddenly, without looking around them.

How drivers can make the roads safer for cyclists

Florida law requires cars and bikes to share the road. It may not be pleasant to be stuck behind a cyclist, but drivers need to remember that the road isn’t just for them.

If you’re driving a car, don’t put yourself aggressively close to a cyclist. Instead, wait until the lane to your left is clear and give yourself plenty of room to pass the bicycle.

Drivers should also practice situational awareness when they’re behind the wheel. If you’re backing out of a driveway or parking space, keep an eye out for other vehicles, motorcycles, bicycles, and pedestrians.

Don’t take blind corners too sharply – leave space, especially on the right, in case there’s a slower moving vehicle on the other side of the turn. Similarly, when making a right turn at a light, double check there aren’t any bicycles in your blind spot.

Additionally, drivers should make it obvious any time they are changing lanes or turning. Using turn signals will signify your intentions, allowing other vehicles, including bikes, on the road to give you room.

Finally, don’t drive or park in a bike lane. Keep these areas clear for bicyclists.

Work with an experienced bicycle accident attorney

Bicycle accidents can be particularly dangerous, given the size disparity between a bicycle and a car. If you’ve been hurt in a bicycle accident, working with an experienced Kissimmee bicycle accident attorney can help you get the help you deserve. Contact Draper Law Office or call 406.846.0075 for a free consultation about your options today.

“Road rage,” may be a term that is thrown around loosely, but it is also a dangerous and increasingly common phenomenon. In fact, statistics reflect that 1 out of every 3 traffic accidents involve road rage.

Road rage can include aggressive driving tactics such as honking, cutting other cars off, driving other vehicles off of the road, speeding, baiting other cars into accidents, and other actions intended to cause harm, confusion, and intimidation. These actions pose a real threat to other drivers on the road, and should not be taken lightly. If you or a loved one have suffered serious injuries as a result of a rageful driver’s aggressive tactics, you do not have to shoulder the burden alone. You can hold this driver responsible for their reckless and malicious conduct by bringing a personal injury lawsuit against them.

Suing for Aggressive Driving

In some cases, road rage may be its own crime, such as where it amounts to reckless driving or involves illegal actions, like cutting people off or merging without using proper signals. However, if someone else’s aggressive driving causes them to be involved in a crash, it constitutes negligent driving. You can bring a personal injury lawsuit to recover for your damages regardless of whether the other driver also faces criminal charges. In order to have standing to bring a personal injury lawsuit, you must demonstrate that the other driver was negligent and that their negligence caused you physical and financial harm. In other words, you cannot sue someone merely for being a rageful driver, even if their conduct was intimidating and alarming. But if that aggressive behavior causes you harm, then you can sue.

In order to be found negligent, a driver must have breached their implied duty of reasonable care to all other drivers on the road. A driver breaches their duty of reasonable care when they violate traffic laws or regulations, or behave in a way that would put other drivers at risk, such as by driving while drowsy, distracted, or in a way intended to intimidate, harass, or distract other drivers on the road. Aggressive driving is often compelling evidence of negligence. You must also be able to provide evidence showing that your physical injuries also caused financial loss. Because personal injury lawsuits are intended to restore a person to the financial position they would have been in had the accident not occurred, there must be a financial injury that can be fixed, otherwise the lawsuit will not serve a purpose. A personal injury lawsuit allows you to pursue compensation for all expenses incurred as a result of the injury as well as compensation for pain and suffering.

Getting into a car crash can be a frightening and overwhelming experience. Whether it’s a minor fender bender or a serious collision, knowing what to do in the moments that follow can make all the difference for your safety, your rights, and your future.

Here are 5 important steps you should take if you’re involved in a crash in Osceola County or anywhere in Central Florida:

Check for Injuries and Call 911
Your safety is the top priority. Check yourself and others for injuries. Call 911 immediately to report the crash and request medical assistance if needed.

Move to Safety
If your vehicle is drivable and you’re not seriously injured, move it to a safe location nearby to avoid further accidents or traffic hazards.

Exchange Information
Collect the name, contact details, driver’s license number, and insurance information of all parties involved. Be sure to also gather the names and contact details of any witnesses.

Document the Scene
Use your phone to take photos of the damage, license plates, the location, and any relevant road conditions or signage. This documentation can be critical for your insurance claim or any legal action.

Seek Medical Attention and Contact an Attorney
Even if you feel fine, some injuries can take hours or days to appear. Visit a medical professional as soon as possible. Then, reach out to a trusted personal injury attorney to protect your rights.

Why Uninsured Motorist Coverage Matters

One of the biggest issues Central Florida drivers face is the high number of uninsured or underinsured motorists on the road. If you’re hit by someone who doesn’t have adequate insurance—or any at all—you could be left with medical bills, car repairs, and lost wages with little to no compensation.

That’s why it’s crucial to add Uninsured/Underinsured Motorist (UM) coverage to your auto insurance policy. It helps cover your expenses when the at-fault driver can’t. It’s one of the smartest and most affordable decisions you can make to protect yourself and your family.

As Osceola County continues to grow into one of the fastest-developing regions in the country, the increasing traffic brings greater demands for vigilance on the road. Distracted driving remains a significant risk to both drivers and pedestrians, especially at busy intersections and crosswalks. Whether it’s checking a text message, fumbling with the radio, or eating while driving, even a momentary lapse in attention can lead to severe consequences.

Since 1984, Draper Law Office has been a staunch advocate for responsible driving and protecting the rights of those affected by road accidents. The firm emphasizes that driving distracted or impaired not only endangers other drivers but also poses a significant threat to pedestrians. Crosswalks are meant to be safe passageways, but they become high-risk zones if drivers aren’t fully focused. By ensuring all road users stay alert and obey traffic rules, we can significantly reduce these preventable tragedies.

If you or a loved one has been impacted by a traffic-related incident, call Charlie Draper at Draper Law Office at 407.846.0075 or visit DraperLawOffice.com to understand your rights and seek legal protection.

In recent years, the use of medical marijuana has become more common across Florida, including right here in Osceola County. And while it’s legal for certified patients to use marijuana under Florida law, driving under the influence—whether from alcohol, illegal drugs, or prescribed medication like marijuana—is still illegal and dangerous.

If you’re behind the wheel, even small amounts of THC in your system can slow reaction time, impair judgment, and increase your risk of causing or being involved in a crash. Unfortunately, many drivers aren’t aware that medical marijuana use is not a legal defense if you’re deemed impaired at the time of a traffic stop or accident.

Marijuana Impairment: A Silent Threat on Our Roads

Even if marijuana is being used for medical reasons, its psychoactive effects can impair your ability to drive safely. According to national traffic safety data, marijuana can:

Slow your reaction time

Affect coordination

Distort depth perception and spatial awareness

Alter judgment and decision-making

In a fast-moving traffic environment like Osceola County’s growing roadways, even a moment of delay can lead to serious consequences.

Under Florida law, driving under the influence of marijuana is treated the same as driving drunk. Whether you have a prescription or not, it’s considered DUI if your driving is impaired. This can lead to fines, license suspension, arrest, and major civil liability if you cause an accident.

And if you’re the victim of a crash caused by someone who was impaired by marijuana, proving fault and recovering damages can become complicated—especially if the other driver is uninsured or underinsured.

Why Uninsured Motorist Coverage is More Important Than Ever

In a state with a high number of uninsured and underinsured drivers, having Uninsured/Underinsured Motorist (UM/UIM) coverage is essential. If you’re hit by a driver impaired by marijuana who doesn’t carry sufficient insurance, your own policy could be the only thing protecting you from medical bills, lost wages, and vehicle damage.

UM coverage ensures you’re not left paying the price for someone else’s recklessness—especially in cases involving impaired or negligent drivers.

Trust Draper Law Office — Advocates for Osceola County Since 1984

When purchasing auto insurance in Florida, one critical aspect that often gets overlooked is uninsured motorist coverage. With a significant number of uninsured or underinsured drivers on the road, in most cases, opting for uninsured motorist coverage (UM) is not just a wise choice, it’s a necessity. Draper Law Office has been protecting people’s rights since 1984 in Osceola County, and has provided some extremely important information regarding the purchasing of auto insurance in Florida.

Florida’s High Rate of Uninsured Drivers:

Florida has one of the highest rates of uninsured motorists in the United States. In fact, it’s estimated that nearly 26% of drivers in the state lack proper insurance coverage. If you’re involved in an accident with one of these drivers, you could be left with substantial expenses and no recourse without uninsured motorist coverage.

Protecting Yourself from Uninsured Drivers:

Uninsured motorist coverage is designed to protect you in situations where the at-fault driver doesn’t have insurance or has insufficient coverage to pay for your medical bills, property damage, or other losses. Without UM coverage, you might have to rely solely on your own insurance, which can be financially burdensome.

Hit-and-Run Incidents:

Hit-and-run accidents are another common scenario on Florida’s roads. If you’re a victim of a hit-and-run, UM coverage can step in to help cover the costs associated with the accident when the responsible party cannot be identified or located.

Underinsured Motorists:

Even if a driver has insurance, their coverage limits may not be enough to fully compensate you for your injuries or damages. Underinsured motorist coverage (UIM), often bundled with UM coverage, can bridge the gap between the at-fault driver’s policy limits and your actual expenses.

Peace of Mind:

Knowing that you have uninsured motorist coverage provides peace of mind when you’re on the road. You can focus on driving without worrying about the financial consequences of an accident caused by an uninsured or underinsured driver.

Comprehensive Protection:

Uninsured motorist coverage not only protects you but also your passengers. It can cover medical bills, lost wages, pain and suffering, and other related expenses resulting from an accident with an uninsured driver.

Cost-Effective Solution:

Adding uninsured motorist coverage to your auto insurance policy is typically an affordable option that can save you from significant financial hardship in the event of an accident with an uninsured or underinsured driver.

When buying auto insurance in Florida, uninsured motorist coverage is not an optional extra—it’s a vital component of a comprehensive insurance policy. Given the high number of uninsured drivers in the state and the potential financial consequences of an accident, UM coverage offers essential protection for you, your passengers, and your vehicle. Don’t wait until it’s too late; make sure to include uninsured motorist coverage in your auto insurance policy to ensure you’re adequately safeguarded on the Sunshine State’s roads. Your safety and financial security depend on it.

Even with information about purchasing uninsured motorist coverage being readily available, understanding how that coverage can affect your personal situation or needs can be challenging, The attorneys at Draper Law Office are a great resource before making those decisions. They’ve been serving the community since 1984 and have seen the results of not having proper auto insurance coverage.

If you’ve been involved in an accident and need to make sure your rights are protected call a proven advocate for the community that understands that insurance companies don’t have your best interest at heart. Draper Law has been fighting for the rights of the people in Osceola County since 1984. In times of need, call Draper Law at 407.846.0075 or visit DraperLawOffice.com.

The holiday season, particularly around Christmas and New Year’s Eve, is a time for joy and celebration. However, it also marks a significant increase in road traffic and, unfortunately, a rise in driving-related incidents in and around Osceola County. This period typically sees a large spike in accidents due to impaired, drunk, or distracted driving, making it crucial to emphasize the importance of driving sober and undistracted.

Why Sober Driving is Critical

Increased Traffic and Risks: During the holidays, there are more vehicles on the road, and the potential for accidents escalates. Drunk or drugged driving significantly contributes to this risk, as evidenced by the surge in DUIs and fatal crashes in Florida during this season [[4†wesh.com]].

The Deadliest Driving Season: Statistics show that the Thanksgiving holiday, in particular, is the deadliest in terms of fatal car accidents in Florida, highlighting the risks associated with holiday travel [[5†armandoinjurylaw.com]].

Preventable Tragedies: Impaired driving accidents are 100% preventable. The Florida Highway Patrol emphasizes this, yet the number of such incidents remains high, often leading to devastating consequences [[4†wesh.com]].

Need for Legal Assistance

For those who have unfortunately been involved in accidents during this holiday season through no fault of their own, it’s vital to seek experienced legal representation. Protecting your rights and ensuring just compensation is critical, and for residents in and around Osceola County, Charlie Draper of Draper Law Office is a name synonymous with trust and expertise.
