In a significant move towards enhancing transparency in homeowners’ associations (HOAs), Florida House of Representative Kristen Arrington (D- Kissimmee) has made notable progress with her proposed legislation, HB 59, titled “Provision Of Homeowners’ Association Rules and Covenants”. This bill is poised to bring crucial changes in the way HOAs operate in Florida.

Under HB 59, homeowners’ associations are mandated to provide every member with copies of the association’s rules and covenants before a specific date and subsequently to every new member. This provision ensures that all members are well-informed about the regulations governing their community. Moreover, the bill obligates associations to update their members with any changes to these rules and covenants, maintaining a transparent and updated flow of information.

Representative Arrington, the driving force behind this bill, expressed her satisfaction with the progress of the legislation. “This legislation will make it easier for residents to be fully aware of current and new rules within their HOA community,” she stated. Emphasizing the importance of the bill, Arrington added, “Any updates to the rules would require the HOA board to distribute them. I am incredibly pleased that this legislation has passed its first committee stop.”

HB 59 has successfully cleared its first hurdle by passing the Regulatory Reform & Economic Development Subcommittee. The bill now advances to its second stop, the Civil Justice Subcommittee, where it will undergo further scrutiny. The passage of this bill through the first committee marks a hopeful step towards its eventual enactment, bringing with it the promise of more informed and engaged HOA communities across Florida.
